Do you know how your cruise is protected?
Since the collapse of XL we are all concerned about how well protected our cruise is. Below are some questions that you have been asking us over the last few days.

 

 

Does my Travel Agent have to be an ABTA member?

Yes, if your travel agent becomes bankrupt and you have paid them money you will get your money back or the company that operates your holiday will honour your holiday so you do not loose out. ABTA is the main association however, there are smaller schemes.

 

I have a cruise booked through a travel agent – do both the cruise line and travel agent have to be with ABTA?

Not all cruise lines are covered by ABTA (eg Royal Caribbean,NCL who are covered by a similar scheme operated by the Passenger Shipping Association (PSA) who offer cover for cruise lines and ferries).  If the cruise line were a member of ABTA and they went into closure then you would get your money back and if you were stranded then ABTA would organise for you to come home.

 

There are lots of mentions of ATOL, what is this?

This is the license that covers any company that puts a holiday together with a flight.  This relates to cruise lines and travel agents.  If an airline was to close then who ever your contract for the holiday package is with is covered by ATOL you would get home, found alternative flights or get your money back.  ATOL is managed by the Civil Aviation Authority.

 

So, if my flight operator closes then do I claim from my travel agent or the cruise line?

It all depends, if your cruise and flight were organised and issued from the cruise line but you bought from a travel agent then it would be the cruise line.  If the cruise is booked through your travel agent and they also organised your flights and would issue your flight tickets then you would claim from your travel agent. Ask your travel agent when booking who will be ticketing the flights.

 

I paid by Credit Card – will I get my money back?
Credit Card Protection only covers the financial amount that you have paid on your card for your purchase but will not cover paying for alternative arrangements to get you back home.  

 

I have taken out holiday Insurance; surely this should cover any eventuality?

No, it depends on what type of insurance that you bought – but many of us buy the standard which covers us for medical reasons.

 

I purchased the cruise from my travel agent and bought my own flights, but the flight operator has closed and I cannot get to my port of embarkation.

Unfortunately, you are not protected as you have taken the responsibility and risk of getting to the port. This also applies if your flight is delayed.

  

I bought a cruise on the internet from a travel agent in America, am I protected?

No, as the American Travel Agent will not hold an ABTA license so if the American Travel Agent becomes bankrupt then you will not get your money back. If the travel agent had not passed on your full payment to the cruise line then you would loose that cruise and money.

We have just returned from a cruise on Navigator of the seas, which was very enjoyable, this is an incredible ship, though can be crowded at times. One niggle I would like to point out, I requested three times that my credit card be charged in dollars so that I used the Visa exchange rate and not Royal Caribbeans exchange rate. Despite this the final bill arrived under my cabin door on the last morning stating that I had elected to be charged in the currency of my credit card (sterling) This resulted in a long and unnecessary queue at the pursers desk to have it corrected.

I would advise checking with your credit card company. I understood from Jan of this year that overseas transactions are not covered by the card protection scheme.

you would get your money back of the amount that you paid on the card but that is it - but remember if something goes wrong while you are in a different country miles away from home - there is nothing that the caredit card will pay.

Travel Agent It all depends by what one means by "travel agent". Not everyone who "sells" a holiday is a travel agent covered by ABTA. "If you were to make a booking with us, you may choose to book flights yourself or with our partner who holds an ATOL license. If you were to book tickets with an airline DIRECTLY you would not necessarily have any cover unless you pay by credit card and the credit card company covers you. If you book with our partner you would be covered by ATOL and in the event that the airline failed - either in terms of repatriation if you were overseas or with refund if you have not taken your holiday. ABTA is a little more difficult to explain. There has been a hugh judicial review over the last couple of years, as the industry had lost faith and number of high profile companies such as TUI leaving the scheme. The upshot is that the government looking to introduce a per passenger levy, although there is no fixed date when that will be. We are not ABTA registered and the main reason for this is that we do not need to be as we only take deposits and balances are paid directly to hotels. Deposits are non-refundable as per our terms and conditions, payable upon booking. Balance are paid according to the hotels payment terms, with most payable when you are in XXXXXXXXX i.e. on receipt of services"

Yes. Credit Card Protection will not cover the cost of alternative arrangements to get you back home. However, provided the amount charged to the card is at least £100, the credit card company becomes jointly and severally liable for the performance of the entire contract. The amount is not limited to the amount charged to the card. It follows that if a cardholder pays an intial deposit of £250 towards a cruise costing £2,500, the credit card company would become liable for the entire £2,500 - even if the remaining £2,250 is paid by cash, cheque, or debit card. This could be a useful way of reducing the amount of the travel agent's credit card fee (based on the total cost), without losing credit card protection.

1.I understood that if at least £100 was paid by credit card, then ALL monies paid could be claimed back under Section 75. Please could you clarify this. 2.You say RCCL is not covered by ABTA, so does that mean any claims would have to be made against the Travel Agent that made the booking, online or otherwise?

I bought a cruise on the internet from a travel agent in America, am I protected? I feel your answer to this question is misleading as it is very likely that a cruise booked in this way would be paid for by a credit card in which case there would be some protection. Mike Reynolds in Spain

I agree the reply was misleading for the reason stated by "reynolds" - and also because the credit card is debited direct by Royal Caribbean in the US- and not by the travel agent
